Workers' Compensation FAQs

In many cases, yes. If you were injured while working, you should file a workers’ compensation claim. The insurer will cover your medical care and replace some of your wages lost while you heal.

Workers’ compensation is a no-fault insurance program. This means that if you’re injured while performing your job duties, you are generally entitled to certain benefits. Importantly, you don’t need to prove that your employer was at fault or negligent in order to receive compensation.

Most employers are required by law to carry workers’ compensation insurance. If an employee is injured on the job, this coverage should provide benefits for medical care and lost wages. Unfortunately, some employers or insurance carriers fail to follow the law or delay the benefits workers are entitled to receive. In these situations, it’s important to contact a workers’ compensation attorney right away to ensure your rights and benefits are fully protected.

Workers’ compensation should cover all medical care related to your work injury. If you’re unable to work while recovering, you’re typically entitled to a percentage of your regular weekly wages until you can return to your job. Additional benefits may be available if your injury results in a permanent disability, such as facial scarring, loss of a limb, or another lasting impairment.

If you’re injured while performing your job duties, you’re entitled to workers’ compensation benefits. Workers’ comp is a no-fault system that provides coverage for medical care and lost wages related to workplace injuries.

If your injury was caused by someone other than your employer, such as a contractor, property owner, or equipment manufacturer, you may also be able to pursue a third-party negligence claim for additional compensation. In some states, it may be possible to bring a third-party claim against your employer, but only when strict legal requirements are met.
